Please read these Terms of Service carefully before placing an order. By submitting a quote request, making a payment, or using any menuFest service, you confirm that you have read, understood and agreed to these terms.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you") and menuFest ("we", "us", "our"), a restaurant menu design service operating from Texas, USA. These Terms apply to all services offered via https://menufest.online, including menu design, branding, digital menus, and any related deliverables.
We reserve the right to update these Terms at any time. Continued use of our services after any change constitutes acceptance of the revised Terms. The date of the most recent revision appears at the top of this page.
2. Services Provided
menuFest provides professional restaurant menu design services including, but not limited to:
- Print menu design (A4, US Letter, bi-fold, tri-fold, booklet formats)
- Digital and QR code menu creation
- Digital menu board design for screens and displays
- Menu engineering and layout strategy
- AR and NFC menu solutions
- Full restaurant brand identity packages
All services are provided remotely. Deliverables are sent electronically as digital files via email or a shared link unless otherwise agreed in writing.
3. Ordering & Payment
An order is confirmed when you submit a completed quote request and we accept it in writing (by email). Full payment or an agreed deposit is required before design work begins. We accept payment via Stripe and PayPal. All prices are listed in US Dollars (USD).
Prices shown on our website are subject to change without notice. The price agreed at the time of your confirmed order will apply to that order regardless of any subsequent price changes.
For larger or custom projects (e.g., Innovation Package), a deposit of 50% may be required upfront, with the balance due upon delivery of the first complete draft.
4. Design Process & Timelines
Upon receipt of payment and your completed creative brief, we will begin work on your design. Estimated delivery timelines are provided at the time of ordering and vary by package:
- Starter — typically 2–3 business days for first draft
- Growth — typically 3–5 business days for first draft
- Full Experience — typically 5–7 business days for first draft
- Innovation — timeline agreed individually based on project scope
Delivery timelines are estimates and not guaranteed. Delays may occur if you are late providing required materials (logo, brand assets, menu content, photos). menuFest is not liable for delays caused by incomplete or late client-supplied information.
5. Revisions Policy
Each package includes a set number of revision rounds as follows:
- Starter — 2 rounds of revisions
- Growth — 3 rounds of revisions
- Full Experience — unlimited revisions within 30 days of first draft delivery
- Innovation — unlimited revisions within the agreed project timeline
A "revision round" means one consolidated set of feedback submitted at one time. Each separate submission of new or additional changes counts as a new revision round. Changes that significantly alter the original brief (e.g., complete concept change, new brand direction) may be treated as a new project and quoted separately.
Revisions must be requested in writing via email. Verbal or phone requests are not accepted as formal revision submissions.
6. Intellectual Property & Ownership
Upon receipt of full payment, you receive full commercial ownership and usage rights to the final delivered design files. You may use these designs for any restaurant-related commercial purpose.
Until full payment is received, all designs remain the intellectual property of menuFest. We reserve the right to display any completed work in our portfolio and marketing materials unless you request otherwise in writing before the project begins.
You warrant that all content, logos, images and materials you provide to us are either owned by you or that you have the legal right to use them. You indemnify menuFest against any third-party claims arising from content you have supplied.
menuFest retains the right to use design concepts and creative approaches developed during your project as inspiration for other client work, provided no proprietary content belonging to you is replicated.
7. File Delivery
Final design files are delivered electronically via email or a download link. Standard deliverables include high-resolution print-ready PDFs and editable source files (Adobe InDesign or Illustrator) where included in your package. Font files are not included due to licensing restrictions; we will advise you on how to source licensed fonts if required.
Download links expire after 30 days. We recommend downloading and backing up your files immediately. menuFest is not responsible for files that become unavailable after the link expiry period.
8. Satisfaction Guarantee
We are committed to delivering designs you love. If you are not satisfied with a delivered design, we will work with you through the revision process to reach a result you are happy with. Our refund policy (available at menufest.online/refund-policy) outlines the specific circumstances under which a refund may be issued.
9. Client Responsibilities
To ensure a smooth project, you agree to:
- Provide accurate and complete business information, brand assets and menu content before work begins
- Respond to design drafts and revision requests within 7 business days (failure to respond may result in the project being paused or closed)
- Ensure all content you supply does not infringe any third-party copyright, trademark or other intellectual property rights
- Review final files carefully before approving — once approved, any subsequent changes will be treated as a new order
- Ensure you have the appropriate licences for any fonts, images or other assets you request us to incorporate
10. Limitation of Liability
To the maximum extent permitted by applicable law, menuFest shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data or business opportunities, arising from your use of our services or your reliance on any deliverable provided.
Our total liability to you in connection with any single project shall not exceed the total amount you paid for that specific project. This limitation applies regardless of the theory of liability (contract, tort, statute or otherwise).
menuFest provides design services — we do not guarantee that a redesigned menu will increase your restaurant's revenue, customer satisfaction or any other business outcome. All claims and projections we share are based on general industry data and are illustrative only.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved first through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration in Texas under the rules of the American Arbitration Association.
You agree that any dispute resolution proceedings will be conducted on an individual basis only and not in a class or representative action.
